The government has introduced legislation that Landlords must comply with. The Energy Performance Certificate (EPC) has been brought in under the EEC directive.
As from 1st October 2008 if you have a property which is currently being marketed to let, it is required by law to have an EPC certificate on each property.
The National Association of Estate Agents (NAEA) have stated that the liability for the penalty charge for not providing an EPC lies with the landlord and not the agent.
From 1st October 2008 you have to provide (at the earliest opportunity) the EPC if you provide written information about the property to a potential tenant, undertake a viewing and at the latest before entering into a contract to rent the property if the landlord wishes to avoid breaching the legislation.
You can market the property without an EPC but you cannot provide written information, undertake a viewing or enter into a contract without the landlord committing a breach of the legislation.
The EPC rates the properties performance in terms of energy use.
There is no need for Landlords to obtain EPC’s for existing tenancies.
An EPC certificate once obtained for that property is valid for up to ten years.
